Carrying While Intoxicated

Wisconsin Statute 941.20 also establishes that it is illegal to possess a firearm while intoxicated. This may also be referred to as endangering safety by use of a dangerous weapon by the negligent operation or handling of a dangerous weapon. A person may be charged with this offense whether they operate or merely are armed with the firearm while under the influence. 

If a motorist is arrested for OWI and are also found to have a firearm in their vehicle, they may likely face gun charges and OWI charges. They may also be asked to forfeit the firearm found in the vehicle.

Penalties for Gun Offenses

In general, the penalties for gun-related offenses like the above are at the Class A misdemeanor level punishable by up to 9 months in jail and a fine of up to $10,000.
